Envirawood Warranty

Environmental Wood, Inc. expressly warrants that for a period of one (1) year from the date of purchase all "Envirawood" products as manufactured by Environmental Wood, Inc. will be reasonably free of defects in materials and workmanship. This warranty is extended only to original purchases from authorized dealers and/or distributors and is non-transferable. Due to the variety of uses and applications to which "Envirawood" products may be put ENVIRONMENTAL WOOD, INC. CAN MAKE NO WARRANTY THAT THIS PRODUCT IS SUITABLE FOR ANY PARTICULAR PURPOSE AND CAN MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, OTHER THAN THOSE SET FORTH HEREIN.

Environmental Wood, Inc.'s "Envirawood" products covered under this warranty are warranted for a period of one (1) year from date of purchase to:

1. Be free from substantial defects in material and workmanship.
2. Not, rot, rust, corrode, develop structural surface cracks or require painting or refinishing.

Environmental Wood, Inc. will at its option, upon documentation and verification of failure, repair or replace the "Envirawood" product without charge, if the herein referenced product fails due to the above defects or, at the option of Environmental Wood, Inc. refund the purchase price to the authorized dealers and/or distributors. This warranty does not include labor costs or miscellaneous costs for removal and/or replacement.

This warranty applies only to "Envirawood" products when properly stored, handled and fabricated will conform, within accepted tolerance, to applicable manufacturing specifications. The warranty does not cover defects caused by:

1. Improper installation, storage, handling and/or fabrication (non-conformance with recognized standards of construction and/or non-conformance to Environmental Wood, Inc.'s specifications.
2. Failure due to any adhesive, caulk or other accessory.
3. Damage (not resulting from defects) while in possession of the Customer.
4. Unreasonable use (including failure to provide reasonable and necessary maintenance). Damage or loss due to improper storage and other catastrophic events such as fire, hurricane and flood.

DISCLAIMER OF WARRANTIES
THE WARRANTIES SET FORTH HEREIN OR IN ENVIRONMENTAL WOOD, INC.'S WARRANTY DOCUMENTS WITH RESPECT TO AN "ENVIRAWOOD" PRODUCT ARE THE ONLY WARRANTIES MADE BY ENVIRONMENTAL WOOD, INC. IN CONNECTION WITH THESE PRODUCTS, AND ARE EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. "ENVIRAWOOD" PRODUCTS SOLD BY ENVIRONMENTAL WOOD, INC. ARE SOLD ONLY TO THE SPECIFICATIONS SPECIFICALLY SET FORTH BY ENVIRONMENTAL WOOD, INC. IN WRITING. ENVIRONMENTAL WOOD, INC.'S SOLE OBLIGATION FOR A REMEDY TO BUYER SHALL BE REPAIR OR REPLACEMENT OF NON-CONFORMING PRODUCTS, OR AT THE OPTION OF ENVIRONMENTAL WOOD, INC. RETURN OF THE PRODUCT AND REFUND OF THE PURCHASE PRICE. BUYER ASSUMES ALL RISK WHATSOEVER AS TO THE RESULT OF THE USE OF THE "ENVIRAWOOD" PRODUCTS PURCHASED, WHETHER USED SINGLY OR IN COMBINATION WITH OTHER SUBSTANCES

LIMITATION OF LIABILITY
No claim by buyer of any kind, including claims for indemnification, whether as to quality or amount of products delivered or for non-delivery of products, shall be greater in amount than the purchase price of the products in respect of which damages are claimed. IN NO EVENT SHALL ENVIRONMENTAL WOOD, INC. BE LIABLE TO BUYER FOR ANY SPECIAL, INDIRECT, INCIDENTAL, RELIANCE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OR COVER, OR LOSS OF PROFIT, REVENUE OR USE IN CONNECTION WITH, ARISING OUT OF, OR AS A RESULT OF, THE SALE, DELIVERY, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS SOLD HEREUNDER, OR FOR ANY LIABILITY OF BUYER TO ANY THIRD PARTY WITH RESPECT THERETO. BUYER SHALL INSPECT FOR NONCONFORMITY PROMPTLY UPON RECEIPT. Failure by buyer to give Environmental Wood, Inc. written notice of claim within 30 days from date of delivery or, in the case of non-delivery from the date fixed for delivery, shall constitute a waiver by buyer of all claims in respect of such products.

This limited warranty gives the purchaser of Environmental Wood, Inc.'s "Envirawood" products specific legal rights. Other rights may be available which vary from state to state.
